These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and PT Pusat Cyberspace dan Inovasi Teknologi Informasi ("Cybernethicc," "we," "us," or "our"), governing your access to and use of the Cybernethicc cloud platform, portal, and all related services (collectively, the "Services").
By creating an account or using any of our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2.1. You must be at least 18 years of age to create an account and use the Services.
2.2. You must provide accurate, complete, and current information during registration and keep your account information up to date at all times.
2.3. You are solely responsible for maintaining the confidentiality of your account credentials, including your password and any API tokens. You must enable two-factor authentication if available for enhanced security.
2.4. You are responsible for all activities that occur under your account, whether or not you authorized those activities. You must immediately notify Cybernethicc at [email protected] if you become aware of any unauthorized use of your account.
2.5. You may not share your account credentials with any third party. Each individual user must have their own account. Cybernethicc offers Access Delegation features for authorized multi-user access within organizations.
2.6. Cybernethicc reserves the right to suspend or terminate accounts that contain false or misleading information, or that are used in violation of these Terms.
Cybernethicc provides cloud infrastructure and platform services, including but not limited to:
3.2. Service specifications, features, and pricing are subject to change. We will provide reasonable notice of material changes that affect existing customers.
3.3. Performance metrics stated in service descriptions represent expected performance under normal operating conditions. Actual performance may vary based on configuration, usage patterns, and network conditions.
3.4. Some Services may be designated as "Coming Soon" or "Beta." Beta services are provided as-is without any uptime or performance guarantees.
4.1. Pre-payment Model. Cybernethicc operates on a pre-payment (top-up) balance model. You must maintain sufficient balance in your billing account before ordering or using paid Services.
4.2. Taxes. All service purchases are subject to Pajak Pertambahan Nilai (PPN/VAT) at 11% in accordance with Indonesian tax law. Balance top-ups are not subject to PPN. All prices displayed are exclusive of tax unless explicitly stated otherwise.
4.3. Payment Methods. Payments may be made through the payment gateways available on the portal, including credit/debit cards, bank transfers, virtual accounts, e-wallets, and QRIS. QRIS payments are limited to IDR 10,000,000 per transaction per Bank Indonesia regulations.
4.4. Refunds. Refund requests must be submitted through the support ticket system with a valid reason and linked to a support ticket. Refunds are evaluated on a case-by-case basis and are not guaranteed. Approved refunds will be credited to your portal balance or returned to your original payment method at Cybernethicc's discretion.
4.5. Recurring Services. Services with recurring billing (such as VPS, domains, or managed services) will be automatically charged from your billing account balance at the start of each billing cycle. If payment fails, Cybernethicc will retry up to 3 times over 72 hours. Services will be suspended after all retries are exhausted.
4.6. Platform Fees. Payment gateway processing fees may apply and are displayed before you confirm your transaction.
4.7. Invoices. Invoices are generated automatically for each successful transaction and are available for download through the portal.
4.8. Auto-deduction. Recurring service fees are automatically deducted from your billing account balance on the due date. Invoices are generated 14 days before the due date to give you time to ensure sufficient balance.
4.9. Insufficient Balance. If your billing account balance is insufficient on the due date, we will retry the charge up to 3 times over 3 days. If payment remains unsuccessful, your service may be suspended.
4.10. Suspension. Suspended services may be restored upon payment within the grace period. After the grace period, data associated with the suspended service may be permanently deleted.
4.11. Balance Responsibility. You are responsible for maintaining a sufficient balance in your billing account. We recommend enabling auto top-up or maintaining a buffer to avoid service interruption.
You agree not to use the Services to:
5.2. Cybernethicc reserves the right to investigate suspected violations and may suspend or terminate Services without prior notice if a violation is confirmed or if immediate action is necessary to protect the platform or other customers.
5.3. You are responsible for ensuring that your end users also comply with this Acceptable Use Policy.
6.1. Uptime Target. Cybernethicc targets 99.9% monthly uptime for production Services (excluding Beta services). Uptime is measured as the percentage of total minutes in a calendar month during which the Service is available.
6.2. SLA Credits. If monthly uptime falls below 99.9%, you may request SLA credits. Credits are calculated at 10% of your monthly service fee for each 0.1% below the 99.9% target, up to a maximum of 100% of that month's service fees.
6.3. Credit Requests. SLA credit requests must be submitted through the support ticket system within 30 days of the end of the affected month. Credits are applied to your portal balance and are not redeemable for cash.
6.4. Exclusions. The SLA does not apply to:
7.1. Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
7.2. Data Ownership. You retain full ownership of all data, content, and materials that you upload, store, or transmit through the Services ("Your Data"). Cybernethicc does not claim any ownership rights over Your Data.
7.3. Data Processing. We process Your Data solely for the purpose of delivering and maintaining the Services you have requested. We will not access, use, or share Your Data for any other purpose except as required by law or valid court order.
7.4. Data Isolation. We implement strict data isolation measures to ensure that each customer's data is segregated and cannot be accessed by other customers.
7.5. Backups. You are responsible for maintaining your own backups of Your Data. While Cybernethicc may provide backup services as an add-on, we are not liable for data loss. We recommend implementing a multi-layer backup strategy.
8.1. Services are delivered through our global network of data centers located across multiple regions. We may utilize third-party infrastructure providers to ensure reliability, redundancy, and global coverage.
8.2. You may select your preferred deployment region where available. Data residency is determined by the region you select at the time of service provisioning.
8.3. Cybernethicc reserves the right to migrate services between infrastructure providers or data centers for operational reasons. We will provide advance notice before any migration that affects service availability.
9.1. Cybernethicc IP. All intellectual property rights in the Services, including software, designs, logos, trademarks, documentation, and other materials created by Cybernethicc, are and remain the exclusive property of Cybernethicc. The Cybernethicc brand is registered with the Directorate General of Intellectual Property (DJKI) of Indonesia.
9.2. Your Content. You retain all intellectual property rights in Your Data and any content you create, upload, or store using the Services. You grant Cybernethicc a limited, non-exclusive license to host, store, and process Your Data solely for the purpose of providing the Services.
9.3. You may not reproduce, modify, distribute, or create derivative works from any Cybernethicc materials without prior written permission.
10.1. By You. You may cancel your account at any time through the portal or by contacting support. Upon cancellation, any remaining balance is non-refundable unless required by applicable law.
10.2. By Cybernethicc. We may suspend or terminate your access to the Services if you violate these Terms, the Acceptable Use Policy, or any applicable law. Where possible, we will provide written notice and a reasonable opportunity to cure the violation before termination, except where immediate action is necessary to protect the platform, other customers, or comply with legal requirements.
10.3. Data Preservation. Upon termination, Your Data will be preserved for 30 calendar days, during which you may request a data export. After 30 days, Your Data will be permanently deleted from our systems, except where retention is required by applicable law.
10.4. Sections of these Terms that by their nature should survive termination (including Limitation of Liability, Intellectual Property, Governing Law, and Data Retention obligations) will continue to apply.
11.1. To the maximum extent permitted by applicable law, Cybernethicc's total aggregate liability arising out of or related to these Terms or the Services shall not exceed the total fees paid by you to Cybernethicc during the twelve (12) months immediately preceding the event giving rise to the claim.
11.2. In no event shall Cybernethicc be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of business opportunities, or business interruption, regardless of the theory of liability.
11.3. The Services are provided "as is" and "as available." Cybernethicc makes no warranties, express or implied, regarding the Services, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
12.1. Cybernethicc reserves the right to modify these Terms at any time. For material changes, we will provide at least 30 days' notice via email to the address associated with your account and/or through a prominent notice on the portal.
12.2. Your continued use of the Services after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the changes, you must discontinue use of the Services before the changes take effect.
13.1. These Terms shall be governed by and construed in accordance with the laws of the Republic of Indonesia.
13.2. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the Pengadilan Negeri Brebes (Brebes District Court), Jawa Tengah, Indonesia.
13.3. The parties agree to attempt to resolve any disputes amicably through negotiation before resorting to litigation.
